By accessing and using the Floxi Application, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Description of Service

Floxi is a sustainability-focused mobile application that:

• Helps users discover and purchase eco-friendly products
• Provides rewards and points for sustainable shopping choices
• Connects users with sustainable brands and businesses
• Offers educational content about environmental sustainability
• Tracks and analyzes users' environmental impact

User Accounts

To access certain features of the Application, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Prohibited Uses

You may not use the Application:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape

Rewards and Points System

Floxi offers a rewards system where users can earn points for sustainable actions. Regarding our rewards system:

• Points have no monetary value and cannot be exchanged for cash
• Points may be redeemed for discounts, products, or services as available
• We reserve the right to modify, suspend, or terminate the rewards program at any time
• Points may expire according to the terms specified in the Application
• Fraudulent activity may result in forfeiture of points and account termination

Intellectual Property Rights

The Application and its original content, features, and functionality are and will remain the exclusive property of Floxi and its licensors. The Application is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

User Content

Our Application may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post to the Application, including its legality, reliability, and appropriateness. By posting content to the Application, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Application will cease immediately. If you wish to terminate your account, you may simply discontinue using the Application.

Disclaimer

The information on this Application is provided on an "as is" basis. To the fullest extent permitted by law, Floxi excludes all representations, warranties, conditions, and other terms which, but for this legal notice, might have effect in relation to this Application.

Limitation of Liability

In no event shall Floxi, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Application.

Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Floxi operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
